I'm working on a government assignment and I need to research court cases in which people we denied or nearly denied their rights to reproduce as a punishment to their crime such as child endangermentDoes anyone know of any court cases in which someone was denied their reproductive rights as a punishment?
You need to look for cases that pre-date 1942.
Buck v. Bell, 274 U.S. 200 (1927) - the woman was sterilized because she was diagnosed as mentally retarded. If memory serves, her IQ wasn't really all that low but she had been the victim of rape by a family member - which prompted her institutionalized.
Skinner v. State of Oklahoma, ex. rel. Williamson, 316 U.S. 535 (1942) - stated that sterilization could not be done as a criminal punishment. Prior to this U.S. Supreme Court decision, compulsory sterilization could be included in the judgment against individuals who had been convicted three or more times of crimes ';amounting to felonies involving moral turpitude';.Does anyone know of any court cases in which someone was denied their reproductive rights as a punishment?
A much more recent case was in Medina County, Ohio where a judge tried to punish a man for lack of child support payments by telling him he'd be jailed if he impregnated anyone again. It was eventually overturned by the Ohio Supreme Court. I don't remember the names, but it was within the last 10 if not 5 years.
You can read up on Buck v. Bell in which Justice Oliver Wendell Holmes famously pronounced ';Three generations of imbeciles are enough';. See links below.
