I need to know cases like mine about an ex accusing sons of sexual abuse on our 3 yr old daughter? ?

My ex and I are going through a divorce and a custody issue. He had tried to get an Emergency custody for our 3 yr old daughter before for allegations on my son but got denied because of no proof. Now he has tried again but this time for sexual abuse and accusing 2 more of my sons. It's all false and now they granted him custody until our next court hearing in a couple weeks. I need to know cases like mine about an ex accusing sons of sexual abuse on our 3 yr old daughter? ?
This is the most serious question I hav ever seen on YA. Be sure you are working closely with your attorney so you can certain to get the correct answer. How old are these brothers and has either admitted to abuse of their sister. Won't the court have psychoanalysis testing done for the boys, girl and possibly even you and your husband. The court has become more wary of these type cases and less prepared to believe abuse actually happened when the accusing spouse has never made thes allegations until divorce proceedings are begun. sounds like he's pulling out all the stops - with this claim might come the unfit mother claim as you were responsible for the child at the time.


as there is no medical evidence of these allegations they stay allegations and not truth.


be mindful of the fathers influence of your daughter - but at least she wont be called to testify in court.


you could see that she is mentally and physically examined before the trial for your defence against the allegations - its not nice to consider but at least shes young enough not to remember the ordeal.


you need to disprove the allegations in order to gain custody - speak to your solicitor or social services for advice.
you will have to have ur daughter testify... and your sons.. and as long as there is no proof he cant take her forever... but think about it... if he really wants your daughter... and he is going to take care of her.. why not just let him have her and get really good visitation rights... divorce doesnt have to be so rough.
As per IPC the custody of girl child is granted to mother %26amp; not father . Regarding allegations of sexual abuse , you Can refer her earlier complaints and the outcome, Besides that has to be supported by the medical reports
He obviously feels that there are grounds for his accusations. Maybe you should open your eyes to just exactly what your sons are doing to their sister.





Thank goodness that her father cares about her physical and mental well being.
If you arent he biological mother, why would you want to take his daughter away from him in the first place ?
