If a solicitor makes a mistake and finds out they have taken on two clients with cases against each other,?

do they drop both party's or choose one and refer the other to some ones else?


as this seems unfair as they now have all the evidence from both party's If a solicitor makes a mistake and finds out they have taken on two clients with cases against each other,?
Its called a professional conflict of interests and the solicitor would be seriously contravening professional ethics to continue to act for both clients. They may have company policy on this, but I guess otherwise the client who was taken on first would be kept on and the other referred.If a solicitor makes a mistake and finds out they have taken on two clients with cases against each other,?
It should NOT happen but I am sure it does from time to time with two different branches of the same firm. i know that this happens ina Barristers Chambers because each Barrister is independent and shares facilities with other barristers The Clerks in Chambers then have a difficult balancing act which they perform with great skill and tactfulness
They really should do a conflict of interests check before they took on either client. How very unprofessional.





That being said, they will need to refer one of those clients elsewhere. If I were one of the parties, I might look for more professional counsel.
If he's seen the evidence, he'd have to resign from both cases.
they should stick with the client that they took on first.
